Lystd Terms of Service

Welcome to Lystd, a social discovery platform owned by QuailSofts LLC that allows people to connect through real-time posts called "Lysts." By accessing or using Lystd, you agree to these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

1. Eligibility

You must be 18 years or older to use Lystd.

By creating an account, you confirm that:

• You are at least 18 years old
• You have the legal capacity to agree to these Terms
• You will comply with all applicable laws and platform policies

Accounts suspected of belonging to minors may be suspended or removed.

2. User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to:

• Provide accurate and truthful information
• Maintain the security of your account
• Notify us of unauthorized access or suspicious activity

Lystd may suspend or terminate accounts that violate these Terms or our Community Guidelines.

3. User Content

Users may create posts ("Lysts") that include:

• Text
• Images
• Tags ("Vibes")
• Approximate location context

You retain ownership of your content. However, by posting on Lystd, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

You are solely responsible for the content you publish.

4. Prohibited Content

The following content is strictly prohibited:

• Escorting or sexual services
• Explicit pornography
• Content involving minors
• Non-consensual intimate images
• Harassment, threats, or abuse
• Violence, self-harm, or illegal activity
• Fraud, scams, or spam
• Hate speech or discriminatory content
• Impersonation or deceptive behavior

Lystd may remove content or suspend accounts that violate these rules.

5. Interactions, Connections & Messaging

Users may interact through Lysts and express interest in connecting. Messaging becomes available only after mutual interest.

Lystd does not verify user identities and cannot guarantee the behavior, intentions, or authenticity of other users. You interact with others at your own risk.

6. Free Features

Lystd provides core features free of charge, including:

• Browsing the Lyst feed
• Creating Lysts (24-hour visibility)
• Viewing nearby posts
• Expressing interest in posts
• Connecting with other users
• Messaging after mutual interest
• Joining group conversations
• Basic feed filters
• Viewing total post view counts

Feature availability may change as the platform evolves.

7. Premium Features

Lystd offers an optional Premium subscription that provides enhanced functionality, which may include:

• Extending Lyst visibility to 48 hours
• Boosting Lysts for increased visibility
• Viewing who viewed your Lyst
• Expanded discovery radius
• Advanced filters
• Multiple active Lysts
• Incognito browsing mode
• Explore mode for other cities
• Ad-free experience
• Premium profile badge

Premium features may evolve over time.

8. Subscription Pricing

Premium subscriptions are currently offered at:

• $9.99 per month
• $79.99 per year

Prices may vary by region and may change with notice where required by law.

9. Billing & Payment

Payments are processed through Apple App Store and Google Play Store.

Lystd does not process or store payment card information. Billing, refunds, and subscription management follow the policies of the respective app store.

10. Auto-Renewable Subscriptions

Premium subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period.

• Renewal charges occur within 24 hours before the period ends
• You may manage or cancel subscriptions in your device settings
• Deleting the app does not cancel your subscription

Any unused portion of a free trial is forfeited upon purchase.

11. Refunds

Refunds must be requested directly through the Apple App Store or Google Play Store. Lystd cannot issue refunds for purchases processed by third-party platforms.

12. Safety, Moderation & Enforcement

Lystd may review or remove content, restrict features, suspend or terminate accounts, enforce bans, and notify law enforcement when required. We are not obligated to monitor all activity but may do so to maintain safety and compliance.

13. Intellectual Property

Lystd is owned by QuailSofts LLC. QuailSofts LLC and Lystd own all rights to the app, branding and logos, designs and UI, software and databases, and features and functionality. You may not copy, modify, distribute, or create derivative works without permission.

14. Privacy

Your use of Lystd is governed by our Privacy Policy, which explains what data we collect, how we use it, how long we retain it, and your rights. By using Lystd, you consent to our data practices.

15. Disclaimers

Lystd is provided "as is" and "as available." We do not guarantee continuous or error-free service, accuracy of content, or availability of matches or interactions. You use the Service at your own risk.

16. Limitation of Liability

To the fullest extent permitted by law: Lystd is not liable for indirect, incidental, or consequential damages. Our total liability will not exceed the amount you paid to us in the last 12 months. Some jurisdictions do not allow certain limitations; in those cases, these limits apply only to the extent permitted.

17. Termination

We may suspend or terminate your account if you violate these Terms, violate Community Guidelines, engage in harmful or illegal behavior, or we are required to do so by law. You may delete your account at any time through the app.

18. Changes to These Terms

We may update these Terms periodically. The updated date will appear at the top of this document. Continued use of the Service after changes indicates acceptance.

19. Governing Law

These Terms are governed by the laws of the United States and the state in which Lystd operates, without regard to conflict-of-law principles.
